Judges, wrote Professor Harry Jones, "are human beings, not ex officio members of the communion of saints, and they often have to hammer out by discourse decisions and doctrines that are not foreordained by anything written in the skies." 1 Yet the literature about judicial decision making generally reflects concern with "the judge" as either an ideal abstract or a specific personality. Little has been written about the development of doctrine by discourse.
